Definitions

In these Terms and Conditions the following words (except where the context otherwise admits) have the following meaning:-

1.     ‘Company’, ‘Whilby Consulting’, ‘We’, ‘Us’, ‘Our’

Means, Whilby Consulting Ltd trading as www.allaboutmyfuture.com, allaboutmyfuture.com for the purposes of business and personal training and development.

Whilby Consulting is the owner of this Website and the ‘allaboutmyfuture’, ‘myvideoCV’ and ‘myvisionCV’ trademarks and brands. We reserve the right to withdraw all or part of the Website at any time.

2.     ‘Courses’

Means any workshop, training course, coaching session delivered via any media, electronic or otherwise, by ‘allaboutmyfuture.com’.

3.     ’Members’, ‘Membership’

Means individuals who have applied for and have been granted membership of the allaboutmyfuture website subject to the terms and conditions contained herein.

4.     ‘Website’/’Site’

Means the all ‘aboutmyfuture.com’ website.

5.     ‘Company Officers’

Means officers of Whilby Consulting Ltd and designated third parties used in the course of our normal business, including but not limited to; the Site webmaster, solicitors, accountants, government officials.

6.     ‘Data’

Means any information uploaded and stored on the website, in whatever form, by the Company or by individual Members.

7.     ‘Terms & Conditions’/’Terms’

Means the Company Terms & Conditions published on the website.

8.     ‘Personal web page(s)’/’Members web page(s)

Means the web pages available to Members for their personal use subject to Terms & Conditions.

9.     ‘You’

Means the user of this Website, associated services and attendee at courses.

10.     ‘Course Fee’

Means the fee payable for the provision of the Courses.

11.     ‘Enrol’, ‘Enrolment’

Means payment for any Course or Service.

12.     ‘Services’

Means any service provided by Whilby Consulting via the ‘allaboutmyfuture’ Website.

13.     ‘Membership Fees’

Means the fee payable for the provision of Membership Services.

14.     ‘Membership Services’

Means the Services provided for Members. Details of Membership Services are published on the Website.

15.     ‘Message Board(s)’/’Job Message Board’

Means the Website pages provided for Members exclusive use.

16.     ‘Privacy Policy

Means the privacy policy published on the Website from time to time and referred to in these Terms.

17.     ‘Copyright Statement’

Means the Copyright Statement published on the Website and set out at Clause 9.2.

1.     Purpose Of This Website

1.1   The purpose of the Website is to provide individuals and businesses with information on the range of Courses, products and other Services offered by Whilby Consulting.

1.2   These Terms and Conditions govern your use of the Website. Please read through them.   If you do not agree with the Terms, do not use this Website. By using the Website, you agree to be bound by the Terms and the Privacy Statement and the Copyright statement.

1.3  The Courses, products and Services featured on the Website are available in the United Kingdom only.

2.     Conditions of your use of this website

2.1   You acknowledge that you are responsible for making back-up copies of all your data and taking appropriate precautions against viruses, hacking and other types of computer misuse.

2.2   Except as stated above, the contents of this Website may not be copied, reproduced, distributed, republished, posted or transmitted in any form or by any means without the prior express written permission of Whilby Consulting.

2.3   You may not distribute, display or copy any of the contents of the pages contained in this web site to third parties including, but not limited to “caching” any material on this web site for access by third parties and “mirroring” any material on this web site.

2.4   If requested we may submit information that we hold about you to local or government authorities.

3.     Provision of service

3.1   Each provision of these terms shall be construed separately as between you and us. If any part is held by a court to be unreasonable, inapplicable or unenforceable, then the other parts shall still apply. These terms apply to all Services provided by Whilby Consulting in whatever format or media.

3.2   If either we or you fail to enforce, or delay in enforcing, any of our respective rights or remedies under these Terms, such failure or delay shall not operate as an agreement to waive that right or remedy, and shall not prevent us from exercising that right or remedy in the future

3.3   The receipt of the services is personal to you and you may not transfer your rights to access any materials relating to any courses or your rights to any Member Services to another person unless we have consented in writing to you doing so.

3.4   We will provide the Services in accordance with the course or membership description which is set out on the Website or which was made available to you via email.

3.5   Services will be provided once we receive cleared payment of our Course or

Membership Fees.

4.     Courses

4.1     We reserve the right from time to time to change the amount of the Course Fee. The current Course Fee will be displayed on the Website.

You shall not be enrolled on a Course until your order has been confirmed by us.  Such confirmation will be made by email to the email address that you provide to us upon registration within 2 days of your order.  If you have not received this confirmation email within 2 days then please contact customerservices@allaboutmyfuture.com

4.2   Once you have been confirmed as enrolled on a Course, if you decide that you wish to cancel your enrolment, you may do so provided that:

4.2.1    You notify us by email to customerservices@allaboutmyfuture.com that you wish to cancel

4.2.2    The cancellation is within the timescales indicated in the Terms and

4.2.3  You have not accessed any materials relating to any courses or obtained tutorial support

4.3   We ask that you give as much notice as possible if you have to cancel a Course as courses are dependent on obtaining a certain level of enrolment.  Late cancellations can cause problems once arrangements have been made for the running of the course and because of this if you decide to cancel your enrolment on a Course you will be given a refund of the course fee, so long as you have satisfied the requirements of clause 4.2, based upon the following:-

4.3.1     if cancellation is received more than 14 days in advance of the course date then course fees will be refunded in full.

4.3.2     If cancellation is received less than 14 days, but more than 7 days, in advance of the course start date then 50% of the course fee will be refunded.

4.3.3     If cancellation is received 7 days or less in advance of the course start date then there shall be no refund of course fees.

5.     Provision of Membership Services (Where Applicable)

5.1  We may provide a Membership Service which is available on the payment of the appropriate fee. Membership Fees are those published on the Website from time to time. Membership allows the publication of member content via various media subject to the limits detailed on the website and in the Terms & Conditions. We reserve the right to remove access to any medium to preserve the security, integrity and purpose of the site.

5.2 You are solely responsible for all material you submit as content in any medium and by     submitting any material you agree to follow these rules.  You may not submit any material which:

5.2.1 advertises or promotes any goods or services;

5.2.2 reveals any confidential or sensitive information;

5.2.3 contains or links to any unlawful, threatening, abusive, defamatory or indecent    material or material which is deliberately intended to upset other users;

5.2.4  contains any material which you do not have permission to use (including material which may be protected by copyright, trademarks, database rights or any other form of intellectual property right);

5.2.5 contains viruses or any other components with harmful or contaminating effects on  the Company Site or any equipment connected to it; or

5.2.6  impersonates any living person.

5.3   We reserve the right from time to time to change the amount of the Membership Fee. The current Membership Fees will be displayed on the Website.

5.4   Membership Services are those published on the Website from time to time. Payment for Membership will be for the Services outlined on the Website at the time of joining. We reserve the right to change and improve Membership Services from time to time.

5.5   When you enrol as a member you will be asked to select a user name and password.  You will be responsible for all activities that occur under your user name and password and you hereby indemnify us in respect of any losses arising as a result of any breach of these Terms or the Privacy Policy through activities that occur under your username and password.  You should take care to keep your user name and password confidential. You must notify us immediately of any unauthorised use of your user name or password or if you believe that your user name or password are no longer confidential. We reserve the right to require you to alter your username and password if we believe that they are no longer secure.

5.6 Membership is only available to individuals residing in the UK and is available to private persons only.

5.7   We reserve the right to refuse Membership to any individual or groups of individuals at our exclusive discretion.

5.8  We reserve the right to terminate the Membership of any individual for breach of the Terms, Copyright Statement, Privacy Policy or for any other reason which Whilby Consulting deems in its reasonable opinion, is against the  general provision of the Terms, Copyright Statement or Privacy Statement. No refunds will be given for any unused Membership in these circumstances.

5.9  You may cancel your Membership at any time and no refunds will be given for any unused Membership.

Message Boards

5.10 As an additional service to Members, we operate various Message Boards, including a Job Message board for Members use. Whilby Consulting reserves the right to withdraw the Message & Job Boards at any time and without notice.

5.11 We reserve the right to ban or suspend an individual’s ability to post on the message boards. If anyone has issues or concerns about a posting, please contact customerservices@allaboutmyfuture.com

5.12   The Message Boards allow you to submit material for inclusion on the Company Site.    Whilst we do not control the submission of material, we do reserve the right to delete, move and edit any material submitted.  Publication will be at our discretion.

5.13   You are solely responsible for the material you submit to the Message Boards and by submitting any material you agree to follow these rules.  You may not submit any material which:

5.13.1 advertises or promotes any goods or services;

5.14 The Company Site offers you a forum to submit material and you agree to be responsible for all the Company’s losses arising out of any breach by you of these rules.

5.15  By submitting material to the Message Boards you are granting us a perpetual royalty-free non-exclusive licence to reproduce, modify, translate, make available, distribute and allow others to use any material you submit in whole or in part of in any form for any purpose whatsoever.  We will try to credit authors of the material where possible, but cannot guarantee to do so.

5.16 The Message Boards contain material submitted by others over which we have no control.  We have asked all users to follow these rules but cannot guarantee the accuracy, integrity or quality of other material.  We do not endorse any of the material published by any others on the Message Boards.

6.     Exclusion of Whilby Consulting’s Liability

6.1 In no event do we accept liability of any description, including liability for negligence (except for personal injury or death), for any damages or losses (including, without limitation, loss of business, revenue, profits, or consequential loss) whatsoever resulting from use of or inability to use this web site or cancellation by us of any course.

6.2  We cannot promise that access to the Website will be uninterrupted or error free. We reserve the right to suspend access to the Website for maintenance.

6.3  There may also be occasions when access to the Website is interrupted for emergency maintenance or repairs or to carry out upgrades to improve the performance or functionality of the Website and the services offered via the Website. Access may also be interrupted due to failures of telecommunications links and equipment, which are beyond the control of Whilby Consulting.

6.4  Using the Website means that you accept that you will not have a claim for breach of contract against the Company or otherwise in respect of such period of unavailability. You also acknowledge that we cannot be held responsible for any delay or disruptions that are inherent in the operation of the Internet and the World Wide Web.

6.5  Whilst every attempt will be made to ensure the Website is free from viruses we make no warranty that the website (or web sites which are linked to it) is free from viruses or malware of any kind.

6.6     We are not responsible for the content of any external sites we provide links to. It is your responsibility to check they follow the same high standards we do. To be absolutely sure, read their privacy policies before giving any personal information. You are solely responsible for any details you disclose over the Internet, so always exercise caution whenever you’re online.

7.     Privacy

7.1   We treat your privacy very seriously. Please read our Privacy Policy if you would like further details about the information we collect and how it is used. By using this Website and submitting personal data you acknowledge and agree that you have understood and accept the terms of the Privacy Policy.

7.2   The information that you provide to us when you pay for a Whilby Consulting course or Website Membership or at any other time is subject to the Whilby Consulting Privacy Policy.

8.     International Use

8.1     We make no promise that materials on the website area appropriate or available for use in locations outside the United Kingdom, and accessing the website from territories where its contents are illegal or unlawful is prohibited.  If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

9.     Law Governing The Terms

9.1   Use of the website and these Terms shall be subject only to the laws of England and Wales which shall exclusively govern the interpretation, application and effect of all the above permissions, exclusions, licences and conditions of use.

9.2   The Courts of England and Wales shall have exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with this web site and its use and these Terms.

We reserve the right to amend these Terms from time to time. When we make a change we will update this page of the Website. If we do so, the updated version will be effective as soon as it is uploaded on to the Website. The date of the last revision to these Terms is provided at the end of the Terms.
